Terms of Service

These Terms govern your use of Galaxy, a business management platform operated by Trackalways ("we", "us"). By creating an account or using Galaxy, you agree to these Terms. If you are using Galaxy on behalf of a business, you confirm you are authorised to accept these Terms for that business.

The service

Galaxy provides tools for CRM, invoicing, inventory, purchasing, accounting, HR and payroll, projects, and related business operations. We may add, change, or remove features over time.

Beta

Galaxy is currently offered as a beta. It is provided free of charge during the beta period and may contain incomplete features. We may change the beta terms, introduce pricing for future use, or end the beta with reasonable notice.

Your account

• You must provide accurate information and keep your credentials secure.
• You are responsible for activity that happens under your account.
• You must be at least 18 years old to use Galaxy.

Your data and content

You retain ownership of the data and content you put into Galaxy. You grant us the limited rights needed to host, process, back up, and display that content so we can provide the service. You are responsible for having the right to use the data you enter — including any personal data about your customers or staff — and for handling it lawfully. Our Privacy Policy explains how we handle personal data.

Acceptable use

You agree not to:

• Break the law or infringe others' rights using the service.
• Attempt to access data belonging to other businesses or users.
• Probe, scan, disrupt, or overload the service or its security.
• Upload malware or content you have no right to share.
• Resell or provide the service to third parties except as intended.

Payments

Where you use Galaxy to collect payments (for example via M-Pesa), those payments are processed by the relevant payment provider under its own terms. We are not a party to the transactions between you and your customers.

Third-party services

Galaxy relies on third-party providers (such as payment, storage, email, SMS, and video services). Your use of those features may also be subject to the providers' terms.

Availability and disclaimer

We work to keep Galaxy available and reliable, but the service is provided "as is" without warranties of any kind. We do not guarantee it will be uninterrupted, error-free, or fit for a particular purpose. Galaxy is a tool to assist your business and is not a substitute for professional accounting, tax, legal, or HR advice.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the service.

Termination

You may stop using Galaxy and delete your account at any time (see Account & Data Deletion). We may suspend or terminate access if you breach these Terms or to protect the service and its users.

Governing law

These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules.

Changes

We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.
